1.Agreement to Terms

By engaging Farr Systems (operated by Jack Farrugia, ABN 30 350 909 100) for any IT support, repair, hardware supply or consulting service, whether verbally, in writing, or by allowing work to commence, you agree to these Terms and Conditions. If you do not agree, please tell me before work begins.

These Terms are available at farrsystems.com.au/terms and are referenced on every quote and invoice. A copy will be emailed or printed for you on request.

If you’re under 18, a parent or guardian needs to accept the quote.

2.Services

2.1 Scope

Farr Systems provides IT support, hardware repair, hardware supply, software configuration, network setup and related technical consulting services to residential and small business clients. Services are provided with due care and skill. Some problems can’t be fixed, or aren’t worth fixing, and I’ll tell you straight if so. This doesn’t affect your consumer guarantee rights, including that services will be fit for a purpose you’ve told me about.

2.2 Variations

If additional work is identified during a job that falls outside the original scope, I will tell you before proceeding. You are not obliged to approve additional work, and no charges apply for work you have not approved.

2.3 Exclusions

Farr Systems cannot guarantee outcomes that depend on third-party software or services, manufacturer hardware faults, pre-existing damage, or conditions outside my reasonable control (for example software licensing issues, internet provider outages, or warranty restrictions).

2.4 Work Through Other Businesses

These Terms apply to work you book directly with Farr Systems. Where I attend a job as a contractor for another business, such as a technician platform or a managed service provider, that business holds the client relationship, and its own terms and privacy policy apply to the job.

2.5 Security Work

Security work lowers your risk; it can’t remove it. No setup can guarantee you won’t be scammed, hacked or infected again.

2.6 Parts You Supply

If you supply your own parts, I’m not responsible for their quality or compatibility, and time spent on a faulty part you supplied is chargeable.

2.7 Declining or Stopping Work

I may decline or stop a job if continuing would be unsafe or unlawful, or would involve unlicensed software or illegal material. You’ll pay only for the work done up to that point.

2.8 Accounts in Your Name

Accounts, licences, domains and subscriptions I set up for you are in your name and belong to you. I’ll hand over every login at the end of the job.

2.9 Banking and Purchases

I won’t log into your online banking, make payments or buy anything for you, except hardware you’ve paid for under a quote.

2.10 Ongoing Arrangements

Ongoing support, where I look after your systems on a regular basis, is set out in a separate written agreement that applies alongside these Terms.

3.Quotes and Pricing

3.1 Quotes

A quote is a fixed price for the work and parts it lists, valid until the date shown. If I find something outside it, I’ll stop and tell you what it is and what it costs before doing it. You’ll never pay more than the quoted total without agreeing to the extra first. You can accept a quote by replying to it by email or text.

3.2 Hourly Work and Travel

Work that isn’t quoted, such as finding a fault whose cause isn’t known yet, is charged at my standard rate, currently $130 an hour. The first hour is a minimum charge; after that, time is billed in 30-minute blocks. Before going past the first hour, I’ll check in with you and agree how far to go. Any reduced rate will be confirmed before work starts.

There’s no travel charge for onsite work within 50 km of Mackay’s city centre. Travel further out, including the Whitsundays, is quoted before booking.

If you go ahead with a job off the back of a paid first-hour consultation, that $130 comes off the job.

3.3 GST

Farr Systems is not currently registered for GST, so no GST is charged. If Farr Systems becomes GST-registered, GST will be added to invoices from that point and you will be told in advance. Quotes already issued will be honoured at the quoted total.

4.Payment

4.1 Payment Methods

The following payment methods are accepted:

  • PayID or bank transfer: details are on every invoice

  • Credit or debit card: available on request, through a secure Stripe payment link. No card surcharge applies. Card details are handled by Stripe and never reach me.

  • Cash: a receipt is issued on request

4.2 Hardware and Parts

Where a quote includes hardware, parts or a custom build, the full quoted amount is payable upfront, before anything is ordered. Nothing is ordered until payment has cleared.

4.3 Labour and Services

Labour and service work is invoiced on completion. Payment is due within 7 days of the invoice date, unless a different arrangement has been agreed in writing.

4.4 Late Payment

Invoices still unpaid 7 days after the due date may attract a follow-up fee of $15.00. To the extent permitted by law, Farr Systems may hold equipment I’ve worked on until payment is received in full.

4.5 Invoice Queries

If you think an invoice contains an error, please contact me as soon as possible, ideally within 7 days of the invoice date. I will review it in good faith and work toward a fair resolution.

5.Your Responsibilities

As a client, you agree to:

  • Provide accurate information about the issue, the device, and any prior repairs or modifications

  • Make sure you have the authority to give Farr Systems access to any devices, accounts or systems worked on

  • Back up your data before work starts (see Section 6)

  • Provide a safe, accessible working environment for on-site visits

  • Disclose any known hardware damage, warranty conditions or relevant history

6.Data Backup and Loss

IT work carries an inherent risk of data loss, including during routine repairs or software changes. You are responsible for backing up your data before any work is performed.

I strongly recommend backing up all important files, photos and documents before any service begins, even for simple tasks. I can do this for you as a separate service if you like.

I take all reasonable care to avoid data loss. To the maximum extent permitted by law, Farr Systems is not liable for data loss arising from hardware failure, software errors, or actions taken in good faith and with reasonable care while performing the services. Nothing in this clause limits any non-excludable rights you have under the Australian Consumer Law.

When I set up a backup, I test that it works at the time. Backups can stop working later, when drives fill, passwords change or software updates. Unless we have an ongoing arrangement where I check them, watching for backup alerts is up to you, and I’ll show you what to look for.

7.Notices Under the Australian Consumer Law

The following notices are given under the Australian Consumer Law. Where a device is left with me for repair, they apply before I accept it.

Repair notice

The repair of your goods may result in the loss of user-generated data, such as files, photos, contacts, messages and settings. Please make sure you have made a copy of any data saved on your goods before handing them over for repair.

Goods presented for repair may be replaced by refurbished goods of the same type rather than being repaired. Refurbished parts may be used to repair the goods.

Consumer guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

8.Privacy and Confidentiality

How I collect, use, store and delete personal information is explained in my Privacy Policy at farrsystems.com.au/privacy-policy.

9.Remote Access and Support

Where remote support is needed, you consent to Farr Systems temporarily accessing your device using remote support software. For normal (attended) support, each session starts only when you approve it, stays visible on your screen, is limited to the agreed work, and ends when that work is done.

Unattended access, where I can connect without you present, is set up only for business clients, under a written authority signed by someone entitled to give it. Every connection is logged, I connect only for the work it covers, and I’ll remove it whenever you ask.

You are responsible for making sure you have the authority to grant remote access to the device or systems involved. Remote sessions are not recorded. I keep basic records of each session (date, duration and work performed) for invoicing and support purposes.

10.Software Licensing

Farr Systems will only install, activate or work on software for which you hold a valid licence. I do not install, assist with or knowingly support pirated, cracked or otherwise unlicensed software. I don’t set up tools for downloading or sharing pirated content, or for getting around copy protection.

Where unlicensed software is found during a job and interferes with the issue or creates legal or security risk, I may decline to continue work on the affected system. Where licensing status is unclear, I will pause and discuss options with you before going further.

11.Warranties and Liability

11.1 Hardware and Parts

Hardware and parts supplied by Farr Systems carry the manufacturer’s warranty. If something fails, contact me and I will handle the warranty claim on your behalf. This is in addition to your rights under the Australian Consumer Law (see Section 7).

For custom builds, each part carries its manufacturer’s warranty and I handle the claims. The build as a whole is covered by the consumer guarantees, which are my responsibility as the business that assembled and supplied it.

11.2 Consumer Guarantees

Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Where a consumer guarantee applies, Farr Systems will honour it.

11.3 Limits on Liability

(a) Except as set out in (d), nothing in this clause limits your rights under the Australian Consumer Law (clause 11.2). Nothing in it limits my liability for death or personal injury, for damage to property caused by my negligence, or for fraud.

(b) Subject to (a), I’m not liable for loss of profits, revenue or business opportunity, or for loss that wasn’t reasonably foreseeable when we agreed the job.

(c) Subject to (a), for business clients my total liability for any claim arising from a job is limited to the fees paid for that job.

(d) Where goods or services aren’t of a kind ordinarily bought for personal, domestic or household use, my liability for a consumer guarantee failure is limited, as section 64A of the Australian Consumer Law allows, to supplying the services again or paying for that, or repairing or replacing the goods or paying for that, unless relying on this wouldn’t be fair or reasonable.

11.4 Insurance

Farr Systems carries professional indemnity and public liability insurance. A certificate of currency is available on request. Nothing in this clause extends the limits of liability set out in clause 11.3, or creates a right to claim against Farr Systems or its insurer.

12.Uncollected Equipment

12.1 Ready for Collection

When your equipment is ready, I’ll tell you by text and email. Please collect it, or arrange delivery, within 14 days.

12.2 Reminder

If it’s still here after 30 days, I’ll send a written reminder by email and post to the details you gave me, and try to call you.

12.3 Abandoned Equipment

If it’s still uncollected 90 days after that reminder and I haven’t been able to reach you, you agree I may treat it as abandoned. I’ll securely erase its storage (or destroy the storage if it can’t be erased), then recycle the equipment responsibly or, if it has resale value, sell it and put the proceeds toward anything you owe. Any surplus is yours, and I’ll hold it for you.

12.4 Records

I’ll keep a record of every notice. Nothing in this clause limits anyone’s rights under the Disposal of Uncollected Goods Act 1967 (Qld).

13.Cancellations and No-Shows

If you need to cancel or reschedule, please give at least 24 hours’ notice. Late cancellations, or not being there at an agreed onsite time, may incur a late-cancellation fee of up to $50 to cover my time and travel. If I need to cancel or reschedule, I’ll give you as much notice as I can, and you won’t be charged anything.

14.Communications and Instructions

Quotes, approvals and instructions exchanged by email or SMS count as written communication for the purposes of these Terms. You are responsible for making sure instructions sent on your behalf, or from accounts associated with you, are authorised.

15.Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the jurisdiction of the courts of Queensland.

16.Changes to These Terms

Farr Systems may update these Terms from time to time. The current version, with its effective date, is published at farrsystems.com.au/terms. An update applies to work booked after it takes effect. It does not change the terms of a job that has already been quoted or started.
